A spent conviction is a conviction that does not appear on most criminal record checks once it becomes spent under Victorian law. There is a list of Government and regulatory bodies who will continue to have access to your record. In practical terms, this means: you are usually not required to disclose it, and employers and others are generally not permitted to ask about it, and the conviction stops defining your future. However, not all convictions become spent automatically and strategy matters. Ways a Conviction Can Become Spent
Spent Immediately
Some matters are treated as spent straight away, most commonly where the court finds you guilty without recording a conviction, or the matter is dealt with by infringement. This is why plea strategy before court is critical.
Spent After a Waiting Period
If a conviction is recorded but is not classed as serious, it may become spent automatically after 10 years (adults) or 5 years (children). The clock usually starts from the date of conviction, but subsequent offending can affect this.
Spent by Court Order (without application)
In specific circumstances involving a serious conviction, the court may immediately deem an offence spent when delivering the sentence.
Spent by Court Application
Some convictions never become automatically spent. In those cases, the only option is to apply to the Magistrates' Court for a spent conviction order. These applications are discretionary, evidence-based, and must be done properly.
Spent Does Not Mean Invisible Everywhere
